Your privacy is important to us and the Genius Sports Group, including Genius Sports Media, Inc. (collectively “Genius Sports”), is committed to protecting and respecting your privacy.
Genius Sports is an international business with offices in the U.S. Our management and business processes cross borders which results in client and employee data being transferred across borders.
Because we may handle Personal Identifiable Information (“PII”) collected from individuals located within the European Union (“EU”) member countries and Switzerland, we have committed to comply with the EU-U.S. and Swiss-U.S. Privacy Shield Principles as set forth by the U.S. Department of Commerce and European Commission regarding the collection, use and retention of PII from EU member countries and Switzerland.
Genius Sports Media, Inc., our U.S. office, has certified that it adheres to the Privacy Shield Principles of notice, choice, accountability for onward transfer, security, data integrity and purpose limitation, access, recourse, enforcement and liability. We are subject to the investigatory and enforcement powers of the Federal Trade Commission. Collection and Use
When we collect PII from you, we are committed to making sure you are informed about who is collecting the information, how and why the information is being collected, and the types of uses we will make of the information. Genius Sports will use information collected only for the purpose for which it was submitted and in accordance with this Privacy Policy and local laws.
Genius Sports maintains offices globally, and as such your PII may be accessed by Genius Sports’ employees worldwide. Our employees must have a legitimate business reason to obtain access to your PII.
Voluntary Submission
We collect your name and email from you when you voluntarily contact us via email or through the Contact Page on www.geniussportsmedia.com (“Website”) to respond to any questions or comments submitted to Genius Sports.
Via Google Analytics
We use Google Analytics to collect information about use of this Website. Google Analytics collects information such as how often users visit this Website, what pages they visit when they do so, and what other sites they used prior to coming to this Website. We use the information we get from Google Analytics only to improve this site. Google Analytics collects only the IP address assigned to you on the date you visit this Website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with PII. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this Website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy . Participation in Our Surveys
From time to time Genius Sports may perform research both online and offline via surveys and interviews. All responses are voluntary. Please note that we may engage a third-party service to conduct such surveys on our behalf, and you will be notified if this is the case.
We will only collect PII which is relevant to our surveys and interviews such as your name, contact information, age, gender, income, education, interests and hobbies and your purchasing habits and behaviors.
Information collected by Genius Sports via surveys and interviews will be used for research and feedback to improve and enhance our current products and services, and to identify broad demographic trends, interests and behavior that may be used to provide information to our customers.
Via Our Products
Connextra, our ad serving product, uses javascript tags and cookies to collect and use data relating to your browsing navigation to display personalized advertisements.
Cookies are small bits on information placed on the hard drive of your computer. Cookies remembers information about your activities on websites where our Connextra product is displayed. We do combine PII with Cookies. Please see our Cookies Policy for additional information.
Through our javascript tags and cookies we collect the following PII: cookie ID, cookie timestamp, IP address or location.
Information, including PII, collected via Connextra is used to determine what creative you are shown when visiting websites, and to increase the relevancy of the ads being displayed to you.
The websites that use Connextra may contain cookies or other tags to collect PII. Genius Sports does not control these websites and visitors to our Customers’ websites should check the privacy policy of those websites to see whether and how it uses cookies.
Via Our Services
Genius Sports performs digital advertising services where we provide our Customers access to an inventory of advertisers via third-party ad exchanges. We work with the following ad exchange platforms: Google, Sovrn, District M, PubGalaxy and RevContent.
Genius Sports does not collect any information in the performance of digital advertising services.
The third-party ad exchange advertisements may contain cookies or other tags to collect PII. Genius Sports does not control these websites and visitors to our Customers’ websites should check the privacy policy of those websites to see whether and how it uses cookies.
Your Choice
You will have the opportunity to opt-in when your PII is initially collected in the EU for certain types of processing.
Genius Sports will not use your PII for any purpose other than which it was submitted unless we obtain your consent.
Onward Transfer
Genius Sports does not disclose, sell, trade or rent your PII to any third parties.
As such, we will not disclose your PII unless we are under a duty to disclose or share your PII in order to comply with any legal obligation or lawful requests by public authorities, including cooperation with an investigation carried out by anybody investigating criminal or fraudulent behavior, and to meet national security of law enforcement requirements.
In the event your PII is transferred by Genius Sports to a third party, Genius Sports is responsible for the processing of PII it receives under the Privacy Shield and subsequently transfers to a third party acting as an agent on its behalf. Genius Sports shall remain liable under the Privacy Shield Principles if our agent processes PII in a manner inconsistent with the Privacy Shield Principles, unless Genius Sports can show that it is not responsible for the event giving rise to the damage.
Security
Genius Sports uses reasonable administrative, technical and operational security measures to safeguard PII in its possession against loss, theft and unauthorized use, disclosure or modification.
Genius Sports uses a third-party, Amazon Web Services, for storing some of the PII we collect. Amazon Web Services participates in the EU-U.S. Privacy Shield Framework.
Access
If you wish to access, correct or delete your PII, please notify us at compliance@geniussports.com or call us at +1 (424) 387 4432 and ask for Maria Hernandes. We will respond to your request within 30 days.
Remedies and Compliance
If you believe we are not in compliance with our Privacy Policy or Privacy Shield Principles, or if you have any questions concerning this Privacy Policy or your PII, we encourage you to contact us at privacy@geniussports.com or call us at +1 (424) 387 4432 and ask for the Maria Hernandes. We will investigate your complaint, take appropriate action and report back to you within 45 days.
If your information has been transferred from the EU or Switzerland to the U.S. and you believe that Genius Sports has not adequately resolved any such issues, you may contact JAMS and the national data protection authorities that Genius Sports has agreed to cooperate with in regards to complaints related to PII.
